2.2. User Responsibilities

By using our services, you agree to:

  1. Provide accurate business information when signing up.
  2. Follow up on leads provided through our services in a timely manner.
  3. Comply with advertising policies set by platforms such as Facebook, Google, and LinkedIn.
  4. Process payments for services and advertising budgets as agreed.

2.3. Payment & Subscription Terms

  • All subscription fees, ad spend, and service fees must be paid according to your agreement.
  • Fees are non-refundable unless otherwise stated in your contract.
  • Failure to pay may result in suspension or termination of services.
  • We do not cover refunds for advertising costs on third-party platforms.

3. LEADS, DATA, AND PRIVACY

3.1. Lead Delivery & Use

  • Ares Digital does not guarantee conversions, unless explicitly stated in your contract.
  • Leads provided are exclusive to your business and should not be shared, resold, or misused.
  • You are responsible for contacting and handling leads within a reasonable timeframe.

3.2. Privacy & Data Use

  • By using our services, you acknowledge that we process personal data as outlined in our Privacy Policy.
  • We may collect and store lead interactions and performance data for quality assurance and reporting.
  • You must comply with GDPR and relevant privacy laws when handling lead data.

4. CONTRACT TERM, CANCELLATION & TERMINATION

4.1. Contract Term

  • Services may be month-to-month or based on a fixed term, as agreed in writing.
  • You may request cancellation in accordance with your contract terms.

4.2. Cancellation Process

  • Cancellation requests must be submitted through our platform or email with proper notice.
  • You remain responsible for any pending payments upon cancellation.

4.3. Termination by Ares Digital

We reserve the right to suspend or terminate your access to our services if:

  • You breach these Terms, fail to make payments, or engage in fraudulent activity.
  • You use leads or data in a manner that violates privacy laws.
  • You damage our brand reputation or engage in unprofessional conduct.

5. GUARANTEES, DISCLAIMERS & LIABILITY

5.1. Service Performance & Guarantees

  • Ares Digital does not guarantee specific results unless stated in your contract.
  • If a guarantee is offered, the terms and conditions of that guarantee will be clearly outlined in your contract.

5.2. Limitation of Liability

  • Ares Digital is not liable for indirect, consequential, or incidental damages.
  • Our liability does not exceed the total fees paid by you in the last 3 months.
  • We are not responsible for third-party service failures (e.g., ad platform bans, social media issues).

6. DISPUTES & GOVERNING LAW

  • These Terms are governed by English law, and any disputes shall be settled in UK courts.
  • If a dispute arises, both parties agree to negotiate in good faith before taking legal action.

7. GENERAL PROVISIONS

  • Changes to Terms – We may update these Terms at any time, and continued use of our services implies acceptance of any changes.
  • No Waiver – Failure to enforce any provision does not waive our rights.
  • Severability – If any provision is found invalid, the rest of the Terms remain in effect.
